Welcome to Visual Atmos. These Terms and Conditions outline the rules and regulations for the use of the Visual Atmos platform and its associated services. By registering an account, purchasing credits, or generating content, you accept these terms in full.

1. Subscriptions, Billing, and Upgrades

Monthly subscription tiers are billed on a recurring, automated basis. You may cancel your subscription at any time through your account portal, which will prevent any future charges. If you choose to upgrade your subscription mid-cycle, you will be charged a prorated amount for the new tier. Upon upgrading, your credit balance will immediately be reset to the full, maximum limit of that newly selected tier, replacing your previous balance.

2. Purchases and Digital Goods (EU Waiver)

All subscription tiers and one-time top-up packages grant immediate access to digital generation credits. By clicking "Generate" and initiating a video or image render, you explicitly consent to the immediate performance of this digital service and acknowledge that you lose your right of withdrawal or refund for those consumed credits.

3. Refund Policy

Due to the high costs of the server infrastructure and AI processing required to generate content, all sales are final. We do not offer refunds for partial subscription months, unused credits, or one-time top-up packages once purchased. Exceptions will only be made in the event of a documented, catastrophic technical failure on the platform's end that prevents the consumption of purchased credits.

4. Data Storage and Asset Deletion

To maintain platform performance and manage cloud storage, Visual Atmos enforces strict automated deletion lifecycles for all generated content.

Videos and Sounds (Audio): All generated video and audio files are automatically and permanently deleted from our servers 7 days after creation.
Images: All generated image files are automatically and permanently deleted from our servers 30 days after creation.

It is your sole responsibility to download and save your generated assets to your personal device within these respective timeframes. Visual Atmos is not liable for any lost, inaccessible, or deleted content once these periods expire, and we cannot recover files once the automated deletion process occurs.

5. Content Ownership and Usage

You retain all rights to the prompts and input you provide. Visual Atmos claims no copyright over the generated video or image outputs. You are free to use the generated assets for personal or commercial use. However, due to the nature of machine learning, we cannot guarantee that outputs will be entirely unique across all users, and you agree not to generate content that violates any laws or third-party intellectual property rights.

6. Acceptable Use and Platform Security

You agree not to attempt to bypass our rate limits, reverse-engineer the platform, or use automated scripts to generate videos or scrape our platform. Any attempt to abuse the platform's API, manipulate the credit system, or utilize unverified accounts to farm resources will result in immediate account termination without a refund.

7. Limitation of Liability

Visual Atmos and its services are provided "as is." We do not guarantee uninterrupted or error-free service. In no event shall Visual Atmos be liable for any indirect, consequential, or incidental damages arising out of your use of the platform.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.
